Builders Need To Beware Of The Changing Nature of Insurance Fire Claims And Litigation

February 9, 2019 by Steve Conboy

The Grenfell Fire in London will hold someone’s liability insurance to the fire. How about your liability in a wood framed building? On June 14 2017, a fire broke out in the 24-storey Grenfell Tower block of flats in North Kensington, West London just before 1:00 am BST; it caused 72 deaths, including those of two victims who later died in a hospital. More than 70 others were injured and 223 people escaped.

Arconic and its board are facing a class action in the US. Brought by investors, the lawsuit alleges that Arconic “knowingly or recklessly” supplied flammable cladding panels for use in highrise structures such as Grenfell Tower in west London. Other current and former board members named include the Indian industrialist Ratan Tata, the former president of Mexico Ernesto Zedillo and Stanley O’Neal, a former chairman and chief executive of the US investment bank Merrill Lynch.

*Could a smart Litigator hold your company responsible in a fire in a raw wood framed fire. Why risk it when the most cost-effective complete fire protection is available now nation wide?

Today all General Contractors and Builders know that OSB , I-Joist and Floor Trusses are very vulnerable to fire and fail faster than solid lumber and plywood.

*Generals Contractors need to defend themselves and push the complete fire protection up hill to the builder. The Builder can than challenge their insurance proiders to lower their risk premiums because there is less risk of total loss and the building is safer during construction and long after tenants have moved in.

NOTICE: Maybe it’s time that General Contractors and Builders in the building industry make sure that everybody’s focus is on top to bottom on total fire litigation management strategies. In 2019, The plaintiff’s bar is more sophisticated, has better technology research, and now has a lot more money invested in the litigation battle for insurance proceeds after two workers died in a recent Denver Fire.

All US General Contractors can contact M-Fire for a free fire defense quote on every job you bid so you can push it up hill to your Builder or Owner. They can reject your advice to fire defend just have them sign off that it was offered and recommended. If they except your advice to make the building safer during construction, they can take the price to their risk management underwriter to ask for support by lowering their premium, because the building has less risk during construction and longer after. If the insurance company is not willing to support less risk they can be help responsible when litigators get involved. The key here is everyone has to push it uphill because if you wait it’s too late.
